Fair Debt Collection Practices Act (FDCPA)
The Fair Debt Collection Practices Act (FDCPA) is a federal statute that regulates the conduct of debt collectors across the United States. It grants individuals the right to recover monies from a debt collector in civil court where a debt collector has violated the FDCPA. Therefore, if you are receiving collection calls or collection notices a debt collector may have to pay you money.
A copy of the federal FDCPA is available at www.ftc.gov/os/statutes/fdcpact.htm
Some states have enacted laws that are more stringent than the FDCPA.
Federal Trade Commission (FTC)
The Federal Trade Commission (FTC) administers the FDCPA and on occasion, the FTC will initiate a prosecution against a debt collector under the Act.
